1. General Information
1.1. These general terms and conditions (the “Terms and Conditions”) apply to the motorcycle training courses offered by Honda Motor Europe, Ltd. – Spanish Branch (“Honda”), with registered address at C/Mar del Nord, 1, Pol. Ind. La Torre del Rector, 08130 Santa Perpètua de Mogoda, Barcelona, through the website www.hondainstitutoseguridad.com
(collectively, the “Courses”, and individually, a “Course”), to which you register via the aforementioned website.
1.2. Honda will provide the Courses at the training center Honda Instituto de Seguridad (HIS), located at C/Mar del Nord, 1, Pol. Ind. La Torre del Rector, 08130 Santa Perpètua de Mogoda, Barcelona. Honda reserves the right to subcontract the delivery of the Courses to third parties with qualified personnel and/or the necessary experience to properly conduct the Courses.
1.3. The Terms and Conditions shall apply to you insofar as you register for any of the Courses as a consumer, as defined under applicable law.
1.4. In order to register for the Courses, you must follow the instructions on the website, namely:
(i) select the Course for which you wish to register (subject to availability);
(ii) if promotions are available for the selected Course, and you have a gift voucher or discount code and wish to apply it to the selected Course, you must request the application of the gift voucher or discount code before completing the registration;
(iii) complete the required information to properly register for the selected Course;
(iv) acknowledge that you have read the privacy policy, expressly accept it, and give your consent for the processing of your personal data in order to access the Course;
(v) acknowledge that you have read the Terms and Conditions and expressly accept them;
(vi) expressly confirm that you understand that registering for the selected Course implies an obligation to pay; and
(vii) proceed with payment of the price of the selected Course.
If you do not agree with the privacy policy and the Terms and Conditions, and do not expressly confirm that you understand that registration implies a payment obligation, you will not be able to register for the selected Course.
1.5. By registering for the Courses, you declare that:
(i) you have the legal capacity to contract or, where applicable, have the consent of your legal representative or guardian to register for the selected Course;
(ii) you possess the permits and knowledge required to participate in the selected Course;
(iii) you are in good physical and mental condition to participate in the Course without compromising your health or physical integrity or that of the other participants; and
(iv) the information provided during registration is accurate, precise, and truthful.
1.6. Honda reserves the right to update or modify the Terms and Conditions at any time. The updated or modified version will only apply to new Courses for which you register. The Honda website will always contain the most up-to-date version of the Terms and Conditions.

2. Information about the Courses and Participation Requirements
2.1. By accessing the website, you can obtain a detailed description of the Courses and participation requirements. By way of example and not limitation, you may obtain information regarding:
(i) availability of places, available dates for the Course, and schedules;
(ii) the motorcycles and equipment that Honda provides for the Course;
(iii) the equipment you must bring to participate in the Course; or
(iv) the knowledge and requirements needed to participate in the selected Course.
2.2. Honda reserves the right to modify the Courses and the requirements for participating in them, provided that such modifications do not affect users who have already registered for the Courses that are being modified.
3. Prices and Payment Methods
3.1. The prices for registering for the Courses are indicated on the website and include applicable taxes and fees. If you have a gift voucher or discount code applicable to the selected Course and wish to use it, you must proceed in accordance with clause 1.4 of these Terms and Conditions.
3.2. Honda reserves the right to modify the price applicable to the Courses, provided that such modification does not affect users who have already registered for Courses whose prices are being modified.
3.3. Payment for the Courses may only be made by credit or debit card through our secure card payment platform. You will be responsible for any charges applied by the issuer of your credit or debit card, your bank, or another payment institution as a result of processing the payment for the Course.
3.4. Honda makes its best efforts to ensure that all prices listed on the website are correct. However, occasional errors may occur and prices listed on the website may be incorrect. In such cases, we will contact you and ask whether you wish to remain registered for the Course at the correct price. If you choose to cancel your registration, we will refund the price paid for the Course.
4. Confirmation and Cancellation of Registrations by Honda
4.1. Once you complete your registration for the selected Course and before the Course begins, we will send you a confirmation email of your registration. Honda will send this confirmation to the email address you provided when registering.
4.2. Notwithstanding the above, Honda reserves the right to cancel your registration for justified reasons, including:
(i) Honda cannot obtain authorization to process payment of the Course fee; or
(ii) there is an error in the price listed on the website for the selected Course and, after contacting you and offering the possibility of continuing with the registration at the correct price, you choose to cancel your registration.
4.3. Additionally, Honda reserves the right to prevent your participation in the Course, without liability, for justified reasons such as:
(i) providing false information during registration;
(ii) not being in suitable physical or mental condition to participate without compromising your health or safety or that of other participants; or (iii) not having the required knowledge or meeting the requirements indicated on the website.
5. Date Changes and Right of Withdrawal
5.1. Requests to change the Course date will not be accepted, and the amount paid will not be refunded, if the request is made less than seven (7) calendar days before the scheduled start date of the Course, unless the request is due to causes beyond your control, including but not limited to injuries that prevent you from participating.
5.2. Honda reserves the right to postpone the start date of the selected Course or cancel it for justified reasons, such as when the number of registered participants does not reach the minimum participation level. If Honda postpones the Course, we will contact you to ask whether you wish to remain registered. If you prefer to cancel, we will refund the price paid.
5.3. Notwithstanding the above, under applicable regulations you have the right to withdraw from the contract within fourteen (14) calendar days from the date the contract was concluded, without providing any justification. To exercise this right, you may notify us of your decision to withdraw by sending an unequivocal statement by postal mail or email, or by using the withdrawal form attached to this document.
In case of withdrawal, we will reimburse all payments made for the Course without undue delay and no later than fourteen (14) days from the date we are informed of your decision. The refund will be made using the same payment method used for the initial transaction.
If the Course has already started before you exercise your right of withdrawal, we reserve the right to deduct from the refund an amount proportional to the part of the service already provided, in accordance with applicable law.
6. Liability
6.1. Honda shall not be responsible for the accuracy or truthfulness of the information you provide when registering for the Course, without prejudice to our right to prevent your participation in accordance with clause 4.3.
6.2. You acknowledge that your registration and participation in the Course is voluntary and that participation involves risks to your health and physical safety. Honda shall not be responsible for damages, injuries, disabilities, or death that you may suffer as a result of your participation in the Course or due to the conduct of other participants.
Notwithstanding the above, you agree to follow the instructions of Honda or the personnel responsible for conducting the Courses in order to minimize the risk of causing or suffering harm, injury, disability, or death.
6.3. Honda shall not be responsible for damage, loss, or theft of personal belongings that have not been stored according to the instructions provided by Honda or the Course staff. In any case, we recommend that you bring only the equipment and documents strictly necessary to participate in the Course, as indicated on the website.
7. Applicable Law and Jurisdiction
7.1. These Terms and Conditions shall be governed by and interpreted in accordance with Spanish law.
7.2. In the event of any issue related to a Course contracted online, and if the claim cannot be resolved out of court through a dispute resolution mechanism, the parties agree that any dispute arising from or related to these Terms and Conditions shall be resolved by the competent courts in accordance with applicable law.
